Terms & Conditions
Last updated: 6 August 2026
1. ABOUT THESE TERMS
These Terms and Conditions apply when you use dragoncitybham.co.uk, create an account, join our loyalty or referral programme, buy a gift card, or place an order with Dragon City (“Dragon City”, “we”, “us” or “our”).
Please read these terms before ordering. By placing an order, you confirm that you are at least 18 years old and that the information you give us is accurate. Nothing in these terms affects your legal rights as a consumer.
2. WHO WE ARE AND HOW TO CONTACT US
Dragon City
186 School Road, Hall Green, Birmingham B28 8PA
Email: dragoncity.bham@gmail.com
Telephone: 0121 702 2474
3. PLACING AND ACCEPTING ORDERS
You can order for delivery or collection using the options shown on our website. Please check your items, quantities, delivery or collection method, address, telephone number, requested time and any notes before submitting the order.
Submitting an order is an offer to buy. A contract is formed when we accept the order and send or display an order confirmation. An automated acknowledgement does not always mean that we have accepted the order.
We may reject or cancel an order before fulfilment if an item is unavailable, an address is outside our delivery area, we cannot safely meet a requested change or allergy requirement, there is an obvious pricing or description error, payment is not authorised, we suspect fraud or misuse, or circumstances outside our reasonable control prevent fulfilment. If we cancel an order after taking payment, we will refund the amount paid for the cancelled items.
4. MENU, AVAILABILITY, PRICES AND PAYMENT
Menu items, options and availability may change. Images are illustrative and presentation may vary. We will not make a material substitution without your agreement.
Prices and any applicable delivery charge are shown before you confirm the order. Delivery charges start from £1.50 and vary by address; the exact charge and any minimum order should be shown after you enter your postcode. We deliver to eligible addresses in Hall Green and selected parts of Shirley, Solihull, Acocks Green, Sparkhill, Moseley, Kings Heath and Yardley Wood.
You must pay using a method offered at checkout. Online payments are processed by the payment provider shown during checkout; we do not receive your full card details. Cash is available only where the checkout specifically offers it.
5. DELIVERY AND COLLECTION
Times shown for preparation, delivery or collection are estimates. We will make reasonable efforts to meet them but factors such as demand, traffic, weather and road conditions can cause delays.
For delivery, you must provide a complete, accurate address, postcode and working telephone number, including access instructions where needed. Someone must be available to receive the order. If we cannot deliver because the information is wrong, access is unavailable or nobody responds, we may charge a reasonable redelivery fee and may be unable to refund food that has already been prepared. We will consider the circumstances fairly.
For collection, please arrive within a reasonable time of the collection estimate and provide the order name or number. Contact us promptly if your order is significantly delayed or has not arrived.
6. ALLERGENS AND FOOD SAFETY
If you have a food allergy, intolerance or coeliac disease, read our Allergen Information and call 0121 702 2474 before ordering. Do not rely only on the order-notes box.
Our kitchen handles multiple allergens and uses shared equipment. Ingredients, brands and preparation methods can change. We will check a request against our current information and tell you if we cannot prepare it safely. A customisation or allergy request is accepted only when a trained member of staff confirms it. Do not eat food that you believe may be unsafe; contact us immediately and seek urgent medical help where necessary.
7. CUSTOM ORDERS
We welcome requests to customise an order, but a request is not guaranteed. It is accepted only when we confirm that it is available and can be prepared safely. Extra charges may apply and will be agreed before acceptance.
8. CANCELLATIONS, CHANGES AND REFUNDS
Please contact us immediately if you need to change or cancel an order. We may accept a cancellation before the kitchen starts preparing it. Freshly prepared takeaway food is normally exempt from the general 14-day cooling-off right because it can deteriorate or expire rapidly.
You are still entitled to appropriate remedies where food or service is faulty, unsafe, not as described, missing, incorrect, or not provided with reasonable care and skill. Our Cancellation & Refund Policy explains how we handle these situations and forms part of these terms.
9. ACCOUNTS, LOYALTY, REFERRALS AND GIFT CARDS
You are responsible for keeping your account and sign-in details secure and for activity carried out through your account. Tell us promptly if you think it has been used without permission.
Our published loyalty rate is 3 points for every eligible £1 spent, and 100 points can be redeemed for £1, subject to the rules shown when you join. Points have no cash value, apply only to eligible direct orders, and may be deducted or restored when an order is refunded. We may correct points added in error and may suspend accounts used fraudulently. We may change or close the programme on reasonable notice, subject to any rights already earned.
Referral rewards are subject to the offer terms shown at the time. Self-referrals, duplicate accounts, false identities and other abuse are prohibited. A reward may be withheld or reversed if the qualifying order is cancelled, refunded or fraudulent.
Gift-card value, any expiry date and specific redemption restrictions will be shown when the card is purchased or redeemed. Gift cards cannot be exchanged for cash except where required by law. Keep the gift-card code secure and contact us promptly if you believe it has been used without permission.
10. WEBSITE USE AND INTELLECTUAL PROPERTY
You may use this website for personal, lawful ordering and information. You must not interfere with the site, attempt unauthorised access, misuse offers, scrape content at scale, introduce malicious code or use our name, logo, photographs, menu content or other materials without permission. Our content is owned by us or used under licence.
11. OUR RESPONSIBILITY
We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for losses that were not reasonably foreseeable, for business losses where you are acting as a consumer, or for failures caused by events outside our reasonable control where we have taken reasonable steps.
Nothing in these terms excludes or limits liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
12. PRIVACY AND COOKIES
Our Privacy Policy explains how we use personal information. Our Cookie Policy explains the cookies and similar technologies used on the website and how you can manage your choices.
13. CHANGES, LAW AND COMPLAINTS
We may update these terms when our services, technology or legal obligations change. The version that applies to an order is the version available when the order is placed, unless a legal change must apply sooner.
These terms are governed by the law of England and Wales. If you are a consumer, you may bring proceedings in the courts that apply where you live in the United Kingdom.
If you have a complaint, contact us first at dragoncity.bham@gmail.com or 0121 702 2474 and include your order number, name and a clear description of the issue.
